If your case has now moved over from either the Child Support Agency and is now with the Child Maintenance Service, and you have seen a huge increase in payments, the likelihood is that all of the correct information needed to make the proper assessment has not been picked up by the Child Maintenance Service via HMRC income records. It could also be an old Departure Direction or Variation Order attached to your previous assessment has followed your case from the old Child Support Agency.
The rules around what is and what is not allowed under the 2012 Variation Scheme are very complex and you should speak to a member of the team about the long term effects on your case in light of the new 25% tolerance rules. In addition, there is also a new system in retrospective assessments based on a failure to disclose information to consider.
The 25% tolerance rule itself is enough to merit a full case assessment check.
The introduction of this rule not only stops regular changes of circumstances but also, if you fail to deal with this rule at the beginning of your case, it will affect how your case is assessed for years to come. This will have a direct bearing on how much income you can take from your company, in particular if you are a shareholder owner.
Paying Parents come to us with many issues from incorrect assessments to debt enforcement. To help you, we offer a range of services from individual telephone advice appointments, data file review and reports, arrears investigation, full case management and Tribunal representation. We can look at your circumstances, check your assessment and advise on enforcement. We tailor the service we give you to your requirements and quote you a fixed fee for the work.
There is now an additional problem for Paying Parents because as the CSA is getting ready to close its existing cases, it is carrying out an internal review of each one and once it signs off any arrears as being correct they will then be permanently fixed and cannot be challenged again. If you have arrears you dispute, you need to tackle this properly now so please get in touch and we can help you with our data file review and report service.
